AB 450 Update - FAQ Document Released for Employers

The California Strawberry Commission has previously released information regarding compliance with AB 450 The Immigrant Worker Protection Act. The new regulation has created confusion for employers as they strive to comply with both state and federal labor laws. Last week California Attorney General Xavier Becerra and Labor Commissioner Julie Su issued joint guidance by releasing a FAQ document for employers.

They reiterated that that the goal of the Act is to protect Californians' privacy in the workplace. During the press conference, Becerra stated the goal is education instead of going after employers. However, it was mentioned that they would rely upon community members to alert them if employers were not following the law. They hope this new document will help with compliance.

The FAQ document includes guidance in several areas including:

  • Explanation of the term "consent"
  • Penalties
  • Explanation of the term "nonpublic"
  • Explanation of a "judicial warrant" and "subpoena"
  • Notice requirements.
